(Oral) Present petition has been filed with a prayer that proper investigation in the FIR No. 33 dated 09.06.2020, under Section 376 of IPC, registered at P.S. Women Police Station, District Palwal be done by the respondents by constituting a Special Investigation Team. Learned counsel for the petitioner states that though approximately three months have has passed since the lodging of the FIR, but no action has been taken by the police in this regard to arrest the accused so far.
Learned counsel for the petitioner submits that the grievance, which is being raised in the present petition, has already been raised before respondent No. 2 i.e. The Inspector General of Police, South Range, Rewari, Haryana by filing a complaint (Annexure P-2) on 18.08.2020 and the said complaint is still pending consideration with respondent No. 2 and the petitioner will be satisfied in case a direction is NARESH KUMAR 2020.09.
CRM No. M-29783-2020 issued to respondent No. 2 to decide the complaint in a time bound manner by passing an appropriate speaking order.
Notice of motion.
Ms. Safia Gupta, learned Assistant Advocate General, Haryana, who has also joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State. Learned State counsel raises no objection with regard to the prayer of the petitioner for deciding the complaint dated 18.08.2020 (Annexure P-2) by respondent No. 2 in a time bound manner. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No. 2 i.e. The Inspector General of Police, South Range, Rewari, Haryana is directed to decide the complaint dated 18.08.2020 (Annexure P-2) of the petitioner within a period of eight weeks from the receipt of copy of this order. In case after the decision, it is found that the action is required to be taken, the same will also be taken at the earliest. Present petition stands disposed of accordingly.
