Daya Chaudhary, J. (Oral) The prayer made in the present writ petition is for issuance of direction to respondents to release the after death benefits to the petitioners on account of death of husband of petitioner No.1, from the date of his death i.e., 21.03.2011.
Learned counsel for the petitioners submits that after the death of husband of petitioner No.1, she approached the respondents-authorities but only compassionate appointment has been given and other benefits like gratuity, leave encashment, provident fund etc. accrued on account of death of her husband have not been released inspite of much delay. CWP No.13288 of 2015 served a legal notice dated 12.02.2015 (Annexure P-2) but no action has been taken thereupon so far. Learned counsel also submits that the petitioners would be satisfied in case, the directions are issued to the respondents to consider the legal notice (Annexure P-2) within some stipulated period.
In view of the submissions made by learned counsel for the petitioners and by considering the fact that the husband of petitioner No.1 has died on 21.03.2011 but after death benefits have not been released so far, the present writ petition is disposed of with a direction to respondent No.2 to consider the legal notice dated 12.02.2015 (Annexure P-2) and take necessary action in accordance with law within two months from the date of receipt of certified copy of this order. In case, the petitioners are found entitled for the benefits sought in the present petition as well as in the legal notice, the same be released to them.
