The writ petition raises series of disputed questions of facts. Any expression of views with regard to the recovery of the alleged misappropriated amount on the basis of alleged oral version of an Officer is likely to cause serious prejudice to the pending trial. Hence the desired direction cannot be issued. (2)
However, petitioner shall be at liberty to have recourse to the remedy as may be available in law at an appropriate stage. (3)
