H. S. Madaan, J. (Oral) This petition for grant of emergency parole has been filed by petitioner - Vishal, a life convict lodged in Central Jail, Bathinda, for the reason that his wife is in family way and he is to look after her, since there is no other person to do so.

This petition is being opposed by State counsel stating that on previous occasion, when he was granted interim bail to attend marriage of his real sister, he did not surrender in the Court within time and did so after 154 days, thereby misusing the concession of Banita Chugh 2017.10.12 18:39 I attest to the accuracy and authenticity of this document chandigarh

Though learned counsel for the petitioner states that nonappearance of the petitioner was not intentional but due to the fact that he was behind the bars, but these assertions could not be substantiated. Though there appears to be little merit in the petition, but on humanitarian grounds, since it is stated that there is nobody else to look after wife of the petitioner, who is in advanced stage of pregnancy, Superintendent Central Jail, Bathinda, may examine the matter and consider the request afresh, as per rules at the earliest.
