Jaswant Singh,J(Oral) Petitioner, on attaining age of superannuation, retired w.e.f. 31.7.2010 from the rank of Warehouse Manager with Punjab State Warehousing Corporation. He was issued a show cause notice dated 7.12.2007(P-1) for imposing minor penalty for recovery on the ground of having caused loss to the respondent Corporation. The same culminated into an order dated 28.5.2013(P-4) ordering recovery of Rs.1,52,983/- on the ground of there being excessive storage loss of stock under the custody and supervision of the petitioner during his service. Although the petitioner in the present petition has laid challenge to the show cause notice P-1 and the punishment order P-4, however, in the alternative he has prayed for a direction to respondent no.3the Appellate Authority to dispose of the statutory appeal filed by him on 18.7.2013(P-5).

Learned counsel for the petitioner at the time of arguments has restricted his claim for a direction to the Appellate Authority to dispose of Rajinder Parshad Joshi 2016.07.28 12:17 I attest to the accuracy and integrity of this document

CWP 12377/2016 the pending appeal(P-5) within a time bound manner as the entire retiral benefits of the petitioner have not been paid so far. In view of the above, without adverting to the merits of the case this petition is disposed of with a direction to the Appellate Authority to dispose of the pending appeal (P-5) expeditiously, preferably within two months from the receipt of certified copy of this order by passing a speaking order.
