Challenge in the present writ petition filed under Articles 226/227 of the Constitution of India is to the order dated 04.04.2024 (Annexure P-11) passed by the Sub-Divisional Magistrate, Kaithal whereby directions were given for removal of the alleged unauthorized possession as well as the notices dated 21.03.2024 and 28.03.2024 (Annexures P-7 and P8) issued by the Gram Panchayat (respondent No.6) under Sections 24(1) and 24(2) of the Haryana Panchayati Raj Act, 1994. 2.

Learned counsel for respondent Nos.6 and 7 states that since certain disputed question of facts have arisen in the present case, the Gram Panchayat, Village Barta (respondent No.6 herein) would approach the Authority concerned by filing a petition under Section 7 of the Haryana YOGESH SHARMA 2026.05.22 09:52 I attest to the accuracy and authenticity of this order/judgment.

CWP-14253-2024 (O&M) Village Common Lands (Regulation) Act, 1961 (hereinafter referred to as the '1961 Act'). However, a prayer has been made that in case any such petition is filed within a period of 15 days from today, the same be decided expeditiously.

In view of the statement made by the learned counsel for respondent Nos.6 and 7, the order dated 04.04.2024 (Annexure P-11) and the notices dated 21.03.2024 and 28.03.2024 (Annexures P-7 and P-8) are set aside. However, liberty is granted to the Gram Panchayat (respondent No.6 herein) to file a petition under Section 7 of the 1961 Act and in case any such petition is filed within a period of 15 days from today, the same shall be decided by the Authority concerned, in accordance with law, expeditiously and preferably within a period of six months from today. 4.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
