Present petition has been filed under Article 226 of Constitution of India, for issuance of a direction to the official respondents to protect the life and liberty of the petitioner who has been receiving imminent threats from the private respondent.

Learned counsel for the petitioner contended that the petitioner had entered into an agreement to sell with Subhash Chand, father-in-law of respondent No. 4, and had paid the entire sale consideration. It is further submitted that possession of the shop was also handed over to the petitioner on the very same day. However, respondent No. 4 is allegedly obstructing the petitioner from opening the shop and extending threats to him. Learned counsel further submitted that the entire incident has been captured in the CCTV footage and the pen-drive annexed with the paper book as Annexure P-2. It is also submitted that the petitioner had submitted a representation (Annexure P-3) before the competent authorities, but no concrete action has been taken thereupon till date.

Mr. Anup Singh, AAG, Punjab, accepted notice on behalf of the respondent-State and submitted that a complaint in the matter had been received; however, no cognizable offence is made out at this stage and the matter is still under inquiry. It is further submitted that the complaint shall be dealt with strictly in accordance with law.

Taking into consideration the submissions made by learned counsel for the parties, the present petition is disposed of with a direction to respondent No. 2-Senior Superintendent of Police, Sangrur, to consider the representation submitted by the petitioner (Annexure P-3) and take necessary action thereupon in accordance with law expeditiously, preferably within a period of four weeks from the date of receipt of a certified copy of this order.
