Dated Police StaƟon SecƟons 16.09.2021 Nihal Singh Wala, District Moga 22 of NDPS Act The peƟƟoner incarcerated in the FIR capƟoned above, has come up before this Court under SecƟon 439 CrPC seeking bail. 2.

In compliance of order dated 24.07.2023, State counsel has handed over the medical report vide Annexure R-1, which is taken on record and as per which, the medical condiƟon of the peƟƟoner is stable and does not require out of jail treatment. 3.

At this stage, counsel for the peƟtoner wants to withdraw the present peƟƟon with liberty to file fresh peƟƟon in case condiƟon of peƟƟoner shall deteriorate. 4.

Given above, the present peƟƟon stands disposed of having been withdrawn. Liberty reserved to the peƟƟoner to file a fresh peƟƟon in case, his health condiƟon deteriorates. It is clarified that in case, fresh peƟƟon is filed, withdrawal of the present peƟƟon shall not come in the way. All pending miscellaneous applicaƟons, if any, stand disposed of.
