Mr. Malkiat Singh, Advocate, for the petitioner. Mr. Shekhar Verma, Advocate, for respondents No.1 and 2. Mr. Jatin Salwan, Advocate, for respondent No.3. ***** Rajan Gupta, J. (Oral) Petitioner has sought a writ in the nature of mandamus to direct the respondents to take immediate action against respondent No.3 for alleged building violations which have led to damage to the flat owned by the petitioner.

Learned counsel appearing for respondent No.3 has, however, controverted this plea. According to him, no violation has been has been made by allottee of the flats.

Mr. Verma, learned counsel representing respondent No.2 submits that the authority is seized of the matter. It shall take appropriate decision after affording an opportunity of hearing to both the parties and after conducting inspection of the site.

In view of the stand taken on behalf of respondent No.2, no further direction of this court is necessary. Petition is disposed of. Needless to observe that in case any party is still aggrieved, it shall be at liberty to seek appropriate remedy.
