(ORAL) This is the petition that has been filed for grant of regular bail to the petitioner in FIR No.91 dated 20.11.2019 registered under Section 498-A, 406 IPC at Police Station Fatehgarh Churrian, District Batala. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the said FIR. It is argued that petitioner and the complainant-wife were residing in Thailand, however, on account of a matrimonial dispute, the instant FIR came to be registered at Batala. On account of the fact that the petitioner was in Thailand, a Look Out Notice was issued and when he came back to India, he was arrested. It is submitted that the petitioner is in custody since 01.08.2021 and is ready to handover his passport to establish his bona fides that he would not leave the country without prior permission of the Court.

Learned counsel for the respondent-State opposes grant of

CRM-M No.35361 of 2021 -2regular bail to the petitioner by contending that the petitioner being a resident of Thailand is likely to abscond.

I have heard learned counel for the parties and in view of the fact that the present FIR is an outcome of the matrimonial dispute and the petitioner herein has himself offered to surrender his passport with the trial court/Duty Magistrate, this Court deems it appropriate to allow regular bail to the petitioner. The instant petition is allowed and the petitioner is directed to be released on regular bail on his execution of personal/surety bonds of `2 lakhs to the satisfaction of concerned trial court/Duty Magistrate. Needless to say that in case passport is not handed over within a period of one week from his release, the State would be at liberty to rearrest the petiitoner. However, any observation made herein shall not be construed to be an expression on merits of the case.
