HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH **** CWP No.1244 of 2016 (O&M) Date of Decision: 21.01.2016 **** Jeet Singh ... Petitioner VS.

State of Punjab & Ors.

... Respondents **** CORAM: HON'BLE MR.JUSTICE SURYA KANT HON'BLE MR.JUSTICE P.B. BAJANTHRI ****

Present:

Mr. Kehar Singh Hissowal, Advocate for the petitioner **** SURYA KANT, J. (Oral) (1) The petitioner claims that land measuring 54 kanal 11 marla situated in the revenue estate of village Bhaini Ariayn, Tehsil Jagraon, District Ludhiana was allotted to his family at the time of Consolidation, as they were found eligible under the 'landless' category. The entire nominal allotment price, however, was not deposited in the year 1970 and out of 2505/- only 585/- was deposited. The petitioner is said to have "expressed his willingness" to deposit the balance amount in his representation dated 30.06.2015 (P4) and has now sought a writ of mandamus to direct the authorities to decide his pending claim. (2) We find that earlier also the petitioner approached this Court through CWP No.28047 of 2013 which he withdrew on 19.12.2013 after arguing for some time "with a view to continue to pursue with his pending representation". It is obvious that this Court was dismissing the writ petition and the same was V.VISHAL 2016.01.27 12:53 I attest to the accuracy and authenticity of this document

withdrawn to pursue the representation. Any subsequent representation does not revive the cause of action. The petitioner or his family has already foregone their right. No case to issue mandamus is made out.

(3) The writ petition is dismissed on account of inordinate delay and laches.
