( ORAL) This is a petition that has been filed for issuance of a direction to the official respondents not to harass and humiliate the petitioner, his son and other family members at the instance of respondent No.5. It is inter alia contended that son of the petitioner has got an appointment in Railway Department as Technician and accordingly, he joined the Railway Department on the post of Technician on 18.08.2020 at Asansole in West Bengal. It is submitted that father in law of daughter namely Hari Singh and another started to pressurize the petitioner herein to solemnize marriage of his son with daughter of their friend i.e. respondent No.5. Respondent No.5 has also made a false complaint against the son of the petitioner. It is also submitted that the matter has been investigated and the petitioner herein has been put to unnecessary harassment. Notice of motion to the official respondents only.
CRM-M No.35221 of 2021 (O&M) -2Ms. Vasundhara Dalal Anand, APP, U.T., Chandigarh, who is present through the medium of video conferencing, accepts notice on behalf of the official respondents and would submit that complaint filed by respondent No.5 has been duly investigated and a report for invoking Section 376 IPC against son of the petitioner has been prepared, which would be sent for approval. She submits that at this stage, presence of the petitioner herein is not required.
I have heard learned counsel for the parties and deem it appropriate to dispose of the instant petition, considering the fact that the matter stands investigated and the challan is likely to be presented after due approval only against the son of the petitioner herein. However, in case presence of the petitioner-Gaje Singh is required with regard to aforesaid complaint made by respondent No.5 by the respondent-State, they will do so after issuance of necessary advance notice of 7 days to the petitioner as envisaged under Section 41-A Cr.P.C.
