H. S. Madaan, J. (Oral) Learned state counsel has placed on file reply by way of affidavit of Dr. Mukesh Kumar, PPS, Deputy Superintendent of Police, Sub Division Nakodar. He has also filed an affidavit by Pritam Kaur - petitioner, to the effect that her son Kulwinder Singh had gone out of house without informing her and after a few days has returned home and she does not want to take any action against ASI Naunihal Singh and SI Paramjit Singh, SHO Police Station Nakodar. In the reply filed by DSP, it is mentioned that FIR No. 302 dated 11.9.2017, under Section 457/380 IPC, had been registered at Police Station Sadar, Nakidar, District Jalandhar, on the statement of Randhir Singh, Bank Manager of Indian Bank, Branch Mallian Banita Chugh 2017.11.22 16:29 I attest to the accuracy and authenticity of this document chandigarh

CRWP-1260 of 2017 -2Khurd, regarding the theft of air conditioner and to break open ATM of Indian Bank, Mallian Khurd; that the investigation of the case was entrusted to ASI Naunihal Singh, Incharge Police Post Uggi; that the name of Onkar Singh @ Sabhi s/o Kuldip Singh r/o village Iddan surfaced during the investigation and Onkar Singh was arrested and the AC was recovered from him; that Onkar Singh @ Sabhi made a disclosure statement that apart from him Sandeep Singh @ Shivji s/o Lehmber Singh r/o village Balnau, PS Shahkot and Satnam @ Sattu s/o Pritam Kaur - petitioner, r/o village Latianwala, were also involved in the case; that ASI Naunihal Singh had raided the house of Pritam Kaur to arrest her son Satnam @ Sattu but the house was locked and Satnam @ Sattu could not be arrested; that he is still absconding and had not surrendered before the police so far; that the police party had never brought Kulwinder Singh, the second son of Pritam Kaur, from her house nor the police officials had demanded any money from her.

In view of the reply and affidavit of the petitioner, placed on the file, no further action in the matter is called for. The petition stands disposed of accordingly.
