HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.63 dated 4.4.2019 under Sections 307,427,148,149 IPC and Sections 25 & 27 of the Arms Act, P.S Division B, Amritsar, District Amritsar. The FIR has been registered on the statement of Robin Rai aged about 20 years with the allegations that he passed 10+2 examination. On 04.4.2019, he had gone to the house of his friend Ankit Mahajan son of Vipan Mahajan to meet him. Rajat Kumar son of Raman Kumar who is also one of his friends was already standing outside his shop. After some time, Manjinder Singh @ Shaila (petitioner) made a telephonic call on the mobile of Kanav Mahajan and asked him as to why he used to come along with Robin. Upon this, Kanav Mahajan said that Robin is his friend and upon which the petitioner enraged and started abusing on the phone itself and asked to stay outside his house, he will teach him a lesson right now. CRM-M-27160 of 2019 #2# side of Mohan Bazar and while raising alarm, Ankur Kahlon fired a shot from his pistol towards the complainant with intention to kill him which hit on the right side abdomen of his friend Rajat whereas Tejpreet Singh fired a shot towards the complainant which hit him on his left wrist. On hearing the sound of fire arm, people gathered at the spot and all the said persons ray away along with their respectively weapons. Learned counsel for the petitioner states that the petitioner is a young boy of about 20 years. He has not been attributed any injury though he is alleged to be carrying a gandasi. The injured was discharged from the hospital after about 3-4 days.
The petitioner is in custody since 06.4.2019. Keeping in view the facts and circumstances of the present case and taking into account the fact that the trial of the case may take long time and no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case, without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed. The petitioner is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate.
