HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.38 dated 11.3.2019 under Sections 379B IPC registered at P.S City South Moga, District Moga.
The FIR is registered on the statement one Karan Kamboj with the allegations that on 11.3.2019 his aunt Uma Kamboj wife of Rakesh Kamboj was coming home on a Rickshaw carrying 12 Tola of gold. At around 11.15 am, when his aunt alighted from the Rickshaw and entered her house, two unidentified persons came on a motorcycle out of whom one person who was sitting as pillion rider snatched away the wallet of his aunt containing 12 tollas of gold and one mobile phone make Honor and thereafter both of them ran away.
Learned counsel for the petitioner states that the petitioner has falsely been implicated and that recovery of mobile phone has been planted upon the petitioner and that co-accused of the petitioner from whom MANOJ KUMAR 2019.06.27 13:50 I attest to the accuracy and integrity of this document
CRM-M-27158 of 2019 #2# recovery of gold articles has allegedly been recovered has since been granted bail. The petitioner is a young man of about 24 years and that no other criminal case is pending against him.
Learned State counsel states that the investigation is complete and challan has been filed.
Keeping in view the facts and circumstances of the present case and taking into account the fact that the trial of the case may take long time and no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate.
