***** MAHABIR SINGH SINDHU, J Present civil writ petition has been filed under Articles 226/227 of the Constitution of India, praying for issuance of a writ in the nature of mandamus for direction to the respondents No.2 and 3 to register the sale deed of the petitioner, with further direction to them to extend the limitation of the certificate dated 22.11.2018 issued by the office of Land Acquisition Collector, Urban Estate Department Haryana, Gurugram regarding the registration of sale deed stamp duty free in view of the Notification dated 03.01.2011(P-2) issued by respondent No.1. Learned State counsel, on insturctions from Mr. Yash Garg, Deputy Commissioner-cum-Collector, Gurugram apprised this Court that sale deed has already been registered in the office of Sub Registrar on 06.01.2021 and the stamp duty of Rs.26.

84 Lakh would be refunded to the petitioner in case an appropriate request in writing is made to the Deputy Commissioner-cum- Collector, Gurugram in this regard. SACHIN MEHTA 2021.01.

CWP-15249-2020(O&M) -2In view of the above stand taken by the respondents, learned counsel for the petitioner wishes to withdraw the present petition with liberty to move the requisite application for refund of stamp duty. Dismissed as withdrawn with liberty aforesaid. Needless to say that in case the desired application is submitted within two weeks from today, needful shall be done by the competent authority within next four weeks as per law.
