IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRWP-1316-2017 Date of decision: 08.11.2017 Gani ..... Petitioner

Versus

State of Haryana and others ..... Respondents

CORAM:

HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. Nafees Ahmad Khan, Advocate for the petitioner. RAMENDRA JAIN, J. (ORAL) Through the instant Criminal Writ Petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. prayer has been made for issuance of a writ in the nature of Habeas Corpus for the release of Samsheeda i.e. daughter of the petitioner, who is in the custody of respondents No. 4 to 6.

Heard.

This is a totally frivolous petition which can also be termed as abuse of the process of law, for the simple reason that the daughter of the petitioner has gone with her brother-in-law (Jija) with her own sweet will and consent and has solemnized marriage with him and then approached this Court vide CRM-M-39367-2017 seeking protection to their life and liberty.

The instant petition, being without merits, is dismissed. November 08, 2017 ( RAMENDRA JAIN ) rishu JUDGE Whether speaking/reasoned Yes/No Whether Reportable Yes/No Rishu Kataria 2017.11.08 16:16 I attest to the accuracy and authenticity of this document
