Through the present petition, the petitioner alleges that his daughter Kiran is in illegal custody of one Tinku Sharma and therefore, seeks a direction to get her released from his possession. Notice of the petition was issued, in response to which, affidavit of Commissioner of Police, Ludhiana has been filed today in Court, which is ordered to be taken on record. As per the afore-referred affidavit, the petitioner had lodged FIR No. 10 dated 12.01.2017, under Sections 363, 366-A IPC, registered at Police Station Ladowal, District Ludhiana City against Tinku Sharma for having abducted his daughter Kiran. During the course of investigation of the said FIR, it transpired that the daughter of the petitioner, after having Monika 2017.03.15 17:00 I attest to the accuracy and integrity of this document

Crl. W. P. No. 135 of 2017 got married with Tinku Sharma, had filed a petition before the Sessions Judge, Ludhiana seeking protection of their life and liberty, which was allowed vide order dated 13.01.2017. The affidavit further goes on to state that Tinku Sharma had filed an application before the Additional Sessions Judge, Ludhiana for the grant of anticipatory bail in the aforesaid FIR, which, through order dated 25.01.2017, was also granted. Thereafter, the petitioner's daughter had suffered a statement under Section 164 Cr.P.C. before the Area Magistrate, Ludhiana that she had married Tinku Sharma on 12.01.2017 and was residing with him on account of her own free will and without any kind of coercion or pressure.
