Mr. Upender Prasher, Advocate, for respondent No.4. RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Article 226 of the Constitution of India has been made for issuance of a writ in the nature of habeas corpus directing respondents No.1 to 3 to get detenue Baljit Kaur, daughter of the petitioner, released from respondent No.4.

Learned counsel for respondent No.4 submits that petitioner has already filed a petition under the Guardian and Wards Act seeking custody of aforesaid Baljit Kaur against his sister, who has expired during its pendency and petitioner has not been granted any relief till date qua custody of the minor.

Considering this aspect of the matter, instant petition is dismissed being not maintainable as the petitioner can seek appropriate remedy by moving an appropriate application against the respondents. (RAMENDRA JAIN) December 01, 2017 JUDGE R.S.
