(Oral) The petitioner who claims to be a bona fide purchaser of the property has approached this Court under Articles 226/227 of the Constitution of India, seeking a writ in the nature of certiorari for setting aside the unauthorized sale of property of the petitioner/3rd party fixed by the non-applicant Bank for 29.06.2016 vide impugned sale notice dated 27.05.2016 (Annexure P-6).

After arguing for sometime, learned counsel for the petitioner submits that he may be allowed to withdraw the present petition with liberty to the petitioner to approach the Tribunal or to take recourse to the remedies as may be available to him, in accordance with law. 3.
