Mr. G.S. Salana, Advocate for the petitioner. HARINDER SINGH SIDHU, J The petitioner is facing trial in case FIR No.372 dated 06.09.2017 under Sections 420,467,468,471 IPC and Section 14 of Foreigner Act & Section 66-D of IT Act, 2000 registered at P.S Sector 39, Chandigarh.
The petitioner was arrested in this case on 07.09.2017 and thereafter released on regular bail vide order dated 25.4.2018 passed by this Court.
Learned counsel for the petitioner submits that the petitioner could not appear before the trial Court on 06.5.2019 as he was suffering from viral fever. He also moved an application seeking exemption but the same was, however, rejected and the bail granted to him was ordered to be cancelled. It is submitted that the non-appearance of the petitioner was not intentional. Learned counsel undertakes that the petitioner shall appear before the learned trial Court on the date fixed i.e 01.07.2019. Notice of motion.

CRM-M-27189 of 2019 #2# Court, accepts notice on behalf of the respondent-UT, Chandigarh. Having heard learned counsel for the parties and taking into account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 01.07.2019. On his doing so, he shall be released on interim bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the trial Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.
This shall, however, be subject to payment of Rs.5000/- as costs to be deposited with the State Legal Services Authority, UT, Chandigarh.
