**** RAJ MOHAN SINGH, J. (ORAL) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.188 dated 08.11.2018, registered under Sections 302/307/148/149 IPC and Section 25 of the Arms Act, 1959 at Police Station Dinanagar, District Gurdaspur.

The FIR was registered at the instance of complainant Piara Singh Nambardar. Six accused were named in the FIR. One unidentified boy was also involved. Name of the petitioner and one Ankush Mahajan @ Thana were included by the complainant in his supplementary statement dated 11.11.2018 on the ground that on the date of lodging FIR, the complainant was upset and could not name the petitioner and the aforesaid Ankush Mahajan @ Thana. It is not in dispute that co-accused has been granted regular bail by this Court in CRM-M-21690-2019 on 16.05.2019. The petitioner is in custody since 12.11.2018. Challan has already been presented.

Learned Deputy Advocate General, Punjab, on instructions

CRM-M No. 27205 of 2019 -2from SI Daljit Singh, Police Station Dinanagar, District Gurdaspur, could not distinguish the case of the petitioner with that of Ankush Mahajan @ Thana, who has been granted regular bail by this Court. In the aforesaid circumstances, without expressing anything on the merits of the case, it would be just and appropriate to treat the case of the petitioner at par with Ankush Mahajan @ Thana for the grant of regular bail.

In view of above, the petitioner is granted regular bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate.

Nothing expressed hereinabove would be construed to be an expression of any opinion on merits of the case. Petition stands disposed of accordingly.
