(Oral) The petitioners have invoked the jurisdiction of this Court under Section 227 of the Constitution of India, for issuance of direction to learned Appellate Authority, for expeditious disposal of Rent Appeal No.105 of 2022 titled 'Space Provider and others Vs. Ranjeev Verma and another'. On the last date, when the case was dealt with by the Coordinate Bench, report was called from the concerned Appellate Authority, which has since been received.

Gone through the report made by the concerned Officer and also perused the zimini orders passed, more particularly, the order dated 22.08.2023. From the said order, it is deciphered that solely on account of the contest between the parties for disposal of an application for mesne profits of the main case, at first instance, or the arguments to be heard on the SONU 2023.09.14 15:48 I attest to the accuracy and authenticity of this document

Considering the recitals of the report, learned Appellate Authority shall take a call of deciding either the application for mesne profits, at first instance, in an appropriate manner, or hearing arguments of the main appeal, but however, an endeavour be made for disposal of the case expeditiously.
