(ORAL) The present petition has been filed under Section 439 of the Code of Criminal Procedure, seeking regular bail in FIR No.282 dated 20.6.2021, under Sections 21(b)/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City Fatehabad, District Fatehabad.

The petitioner was granted interim bail by this Court in view of a Division Bench judgment of this Court in Inderjeet Singh @ RAJ KUMAR ARORA 2022.03.28 18:14 I attest to the accuracy and integrity of this document

CRM-M-35440-2021 (O&M) Laddi and others Vs. State of Punjab, 2014(3) RCR (Criminal) 953, on 3.9.2021 and it was also directed that when the FSL report is received then the police shall be duty bound to inform the learned counsel for the petitioner so that the petitioner may surrender before the police authorities. Today, learned State counsel has submitted that the FSL report was received on 23.11.2021 and the learned counsel for the petitioner was duly informed on the same day when the FSL report was filed in the Court but despite the same, the petitioner has not surrendered before the police authorities/jail.

The learned counsel for the petitioner has submitted that he has not been able to contact the petitioner and therefore, he has no instructions to say whether the petitioner has surrendered or not. In view of aforesaid position, the interim bail granted to the petitioner is hereby cancelled. The main petition for regular bail is also dismissed in view of the conduct of the petitioner as aforesaid. However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant only for the purpose of decision of present petition. March 24, 2022.
