The petitioner will have no remedy in the manner sought through a writ petition that the cow dung must be removed from the street. If it is an act of nuisance committed by private individuals, the remedy of the petitioner will be to file an appropriate suit giving evidence of nuisance and then seek for its abatement. If it is an action against the public authority, the petitioner will still have a remedy under Section 133 Cr.P.C for effective redressal before the jurisdictional Executive Magistrate.
