Daya Chaudhary, J. (Oral) Learned counsel for the petitioner submits that the petitioner retired from respondent-department on 30.06.2009 as Panchayat Officer. After his retirement, no benefit was released like gratuity and regular pension. Learned counsel further submits that the petitioner was suspended due to registration of criminal case but subsequently, he was acquitted by the trial Court. The period of suspension i.e., from 17.02.2009 to 13.04.2009 was treated as duty period for all intents and purposes vide Government order dated 02.01.2015 but still salary of that period has not been released. Learned counsel also submits that 1st and 2nd installment of benefit of NEETU RANI 2015.07.15 10:59 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.13632 of 2015 revision of pay scales with effect from 01.01.2006 was already released and the 3rd installment has been released subsequently. Learned counsel for the petitioner also submits that the petitioner moved a representation (Annexure P-2) but only some of the benefits were released. Learned counsel also submits that the petitioner would be satisfied in case, directions are issued to respondent No.4 to consider the representation and release the remaining benefits.

In view of the submissions made by learned counsel for the petitioner, the present writ petition is disposed of with a direction to respondent No.4 to consider the present writ petition as well as representation (Annexure P-2) and take necessary action in accordance with law within a period of two months from the date of receipt of certified copy of this order.

Disposed of accordingly.
