**** RA-RS-39-2023 Vide detailed judgment dated 4.5.2023 RSA No. 2511 of 1989 (O&M) was disposed of. Now the appellant has filed an application for review of the same.

After going through the application and hearing learned counsel for applicant-appellant, I am of the considered view that the applicant wants the Court to reopen the controversy and give a fresh decision on mertis, which is outside the purview of review under Section 114 and Order 47 CPC. The remedy of the applicant-appellant lies in filing appeal as per law and the application for review cannot be accepted being misconceived and without merit. The same stands dismissed accordingly.
