The petitioner seeks emergency parole for a week under Section 3(1)(c) of Haryana Good Conduct Prisoners (Temporary Release) Act, 1988, on the ground that marriage of his sister is fixed for 30.12.2017. [2] Notice was issued to Advocate General, Haryana and the authorities were directed to verify the factum of the marriage of petitioner's sister on 30.12.2017. Learned Additional Advocate General, Haryana has produced the original report sent by SHO, Police Station Mahesh Nagar, Ambala, dated 21.12.2017 and as per the said report the factum of marriage of petitioner's sister has been found to be correct. We are, thus, of the view that petitioner is entitled to be released on parole for some days to attend the Meenu 2017.12.22 12:19 I attest to the accuracy and authenticity of this document chandigarh marriage of his sister.
CRWP-1529-2017 -2- [3] However, besides the fact that the petitioner is a life convict in FIR No.240 dated 08.07.2013 under Sections 365, 302, 201, 212, 120-B read with Section 34 IPC at Police Station Mahesh Nagar, Ambala, four more criminal cases mostly under Sections 307, 353, 332, 474 and Arms Act etc. are registered against him. Owing to the involvement of the petitioner in multiple criminal cases, we are of the view that the petitioner be released on parole from 28.12.2017 to 02.01.2018 (both days inclusive) subject to his furnishing heavy surety/bail bonds to the satisfaction of CJM/Duty Magistrate, Ambala. The Senior Superintendent of Police, Ambala is directed to assess the law and order situation in petitioner's mohalla/village and if there is apprehension of any untoward incident, adequate police force be deployed. The petitioner is directed to surrender on 02.01.2018 before 4.00 p.m. before jail authorities.
[4] A copy of this order be given Dasti to learned State counsel for information and necessary compliance.
