Prayer as addressed in this writ petition reads as under:- "

For issuance of a writ in the nature of mandamus directing the respondents to grant/release family pension and complete service benefits for the service rendered by the wife of the petitioner with the respondent Nagar Council, to the petitioner (including gratuity, dearness allowance, GPF/PF, leave encashment, medical allowance etc. and arrears of increment and other arrears) and grant of ExGratia payment as per Government Letter dated 13.10.2010 (P-5) i.e. Rs.3,55,920/- and revised pay scale as per the 6th Punjab Pay Commission alongwith interest @ 18% p.a. for delay in the payment of above mentioned service benefits till its realization, in view of judgment passed by full Bench judgment of this Hon'ble High Court in case of A.S. Randhawa vs. State of Punjab and others, cited as 1997 (3) SCT 468."

Petitioner's wife, it is submitted, who was working as Safai Sewak with the office of respondent No. 3, passed away on 13.05.2021. However, benefits due to the petitioner and ex-gratia payment i.e. Rs.3,55,920/- as per RITU SHARMA 2022.07.26 11:17 I attest to the accuracy and integrity of this document

 

-2government letter dated 13.10.23010 are not being released without any rhyme or reason. In this respect, representation dated 20.05.2022 has been submitted by the petitioner but to no avail.

At this stage, learned counsel for the petitioner restricts the prayer for a decision on representation dated 20.05.2022 (Annexure P4), submitted by the petitioner, in a time bound manner.

Keeping in view the limited prayer addressed, facts and circumstances of the case but without expressing any opinion on the merits thereof, this writ petition is disposed of with a direction to the competent authority, to decide representation dated 20.05.2022 (Annexure P4) by passing a speaking order, within three months from the date of receipt of certified copy of this order. Amount, if any, found due to the petitioner be released within two months thereafter.
