Raghbir Singh And ORS v. State Of Punjab And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No.17101 of 2019 Date of decision:July 01, 2019 Raghbir Singh and others
...Petitioners
Versus
State of Punjab and others
...Respondents
Coram:
Hon'ble Mr. Justice Rakesh Kumar Jain
Present:
Mr. C.L. Premy, Advocate, for the petitioners.
**** Rakesh Kumar Jain, J. (ORAL) Admittedly, the petitioners were not the parties before the Court below in the proceedings initiated by the Gram Panchayat under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 and are basically espousing the pubic cause. Thus, in the absence of any personal interest in the litigation, much-less the locus standi, the writ petition is not maintainable in its present form.
Faced with these observations, counsel for the petitioners prays for withdrawal of this petition with liberty to avail an appropriate remedy by filing a Public Interest Litigation.
Dismissed as withdrawn.
Liberty is granted.
