Counsel for the review applicant-petitioner has sought to raise an argument that the change of date of birth was at the instance of the employer and not requested by the employee and therefore, the basis of the judgment dated 16.07.2020 under review is not sustainable. It has been put to the counsel that if there is any tangible material on record in the form of any unimpeachable evidence in the form of certificate from the Registrar, Births and Deaths to show that the year of birth is 1960 as claimed in contrast to the matriculation examination certificate, whereby the date of birth is shown as 03.08.1957. Counsel has replied in the negative.
