The challenge in this writ petition filed under Articles 226/227 of the Constitution of India is to the order dated 13.06.2016 (Annexure P-1) passed by respondent No.3 whereby the contract awarded to the petitioner-Firm was terminated and it was blacklisted without adhering to the clauses of the agreement and without affording an opportunity of hearing to it. 2.

Notice of motion was issued on June 23, 2016. 3.

Learned counsel for respondents No.2 to 4 has produced a copy of the letter dated 17.10.2016 issued by the Chief Regional Manager and Duly constituted Authority, Hindustan Petroleum Corporation Ltd. in Court today wherein it has been stated that the Tank Trucks of the petitioner-Firm have been Sonia Kinra 2016.10.21 11:20 I attest to the accuracy and integrity of this document High Court, Chandigarh

CWP No.12768 of 2016 (O&M) -2- ---- blacklisted for a period of five years w.e.f. 13.06.2016 till 12.06.2021. The same is taken on record, subject to all just exceptions. It has been submitted by learned counsel for respondent Nos.2 to 4 that in view thereof, the present petition has been rendered infructuous and may be disposed of as such. 4.

However, learned counsel for the petitioner prayed that liberty be granted to the petitioner to challenge the impugned order dated 13.06.2016 (Annexure P-1) as well as the letter dated 17.10.2016 by way of filing fresh writ petition, if so desired. 5.

Disposed of as infructuous.

However, it shall be open to the petitioner to take recourse to the remedies as may be available to it in accordance with law.

Consequently, Civil Misc. No.10154 of 2016 is also disposed of as infructuous.
