The petitioner prays for grant of pre-arrest bail in a criminal case arising from FIR No. 224 dated 07.08.2020, registered under Section 61 of the Excise Act, 1914, Section 188 IPC and Section 51 of the Disaster Management Act, 2005, at Police Station Bhawanigarh, District Sangrur. As per the case of the prosecution, on being stopped by the police, the petitioner ran away, however, from the car left behind by him, 60 bottles of country made liquor were recovered. These liquor bottles were not permitted to be sold or brought in the State of Punjab and these have unauthorisedly smuggled in the State without paying the revenue. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case as the police had taken away the car and planted the recovery of liquor.

Criminal Misc. No. M- 29752 of 2020 This Court has considered the submissions, however, expresses its inability to accept the same at this stage. Hence, no ground is made out to grant the concession of pre-arrest bail to the petitioner particularly when as per the case of prosecution illegal liquor had been allegedly smuggled in by the petitioner and the car in question is owned by him.
