**** RITU BAHRI, J. (Oral) Present petition has been filed for seeking directions to the respondents to grant emergency parole to the petitioner for a period of six weeks to seek treatment for his deteriorating condition due to suffering from polio.

Learned State counsel has placed on the reply filed on behalf of respondent Nos.1 and 2 whereby they have taken the stand that as per medical report submitted by the Medical Officer of this Jail the petitioner has not shown serious illness and the emergency parole can only be granted to the prisoners who is seriously ill, as per Section 3(1)(a) of The Haryana Good Conduct Prisoners (Temporary Release) Act, 1988. Perusal of medical report of the petitioner (Annexure R-2), Naresh Kumar 2017.03.22 11:27 I attest to the accuracy and integrity of this document Chandigarh submitted by Medical Officer, Central Jail-I, Hisar, shows that he is

CRWP-201-2017 -2suffering from compressive Myelopathy and post polio Rt. and Lt. Leg pain and also complaining of pain lower part of back. History of weakening and muscle wasting of Rt. Leg 1st and later he is also getting weakening and muscle wasting of Lt. Leg, which is increasing day by day. Further, he is also having history of uncontrolled urination and presently he is using crutches Rt. Leg. It is also stated that after being shifted to Central Jail-I, Hisar, he has also referred to PGIMS, Rohtak for check up. After hearing the learned counsel for the parties, going through the medical report (Annexure R-2), this Court is of the considered view that the case of the petitioner falls under Section 3(1)(a) of The Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 and accordingly the respondents are directed to release the petitioner on emergency parole for a period of three weeks i.e. 23.03.2017 to 13.04.2017, on his furnishing adequate bail bonds and surety bonds to the satisfaction of the District Magistrate, Hisar.

However, he is directed to surrender before the Jail Authorities on 14.04.2017 at 10.00 AM positively.
