**** SANJAY VASHISTH , J. (Oral) Order dated 21.07.2022 says as under:
"This petition has been filed under Articles 226 of Constitution of India seeking direction to respondents No. 2 and 3 to provide protection to the lives and liberty of the petitioners at the hands of respondents No. 4 and 5. The date of birth of petitioner No. 1 is 18.09.1995 while date of birth of petitioner No. 2 is 06.01.1998. Copies of Aadhar cards showing date of birth of petitioner No. 1 and petitioner No. 2 are attached as Annexure P-1 and Annexure P-2 respectively.
It is the case of the petitioner that petitioner No.1 was married with Kunal Khanna-respondent No.5 on 17.01.2020. One male child namely, Anant Khanna was born from this marriage. The minor is presently with Petitioner No.1. Petitioner No.2 was also earlier married and had obtained decree of divorce by way of mutual consent vide order dated 12.10.2020 passed by Principal Judge, Family Court, Barnala. It has been submitted that petitioners are known to each other since long. They are residing in live-in relationship. It is stated that petitioners apprehend danger to their life and liberty at the hands of respondents No. 4 and 5. In this regard, petitioners have submitted representation dated 06.07.2022 (Annexure P6) to respondent No. 2 seeking protection of their lives and liberty at the hands of the private respondents.
Learned counsel for petitioners submits that petitioner No. 2 has undertaken to prepare an FDR for an amount of Rs. 100,000/- (Rs. One lac) in the name of child of petitioner No. 1 i.e. Anant Khanna. The said FDR be prepared within two weeks KAVITA NAIN 2023.03.
CRWP-7005-2022 - 2 - and the copy of same be produced in the Court on next date of hearing.
Adjourned to 09.08.2022 for compliance.
In the meanwhile, respondent No. 2 (Senior Superintendent of Police, Malerkotla) is directed to look into representation dated 11.07.2022 (Annexure P-3) and take necessary action as may be warranted in law.
It is clarified that this order is limited to protection of life and liberty of the petitioners. It does not and cannot confer immunity to the petitioners from any legal action at the hands of spouse of petitioner No.1 and her rights/obligations/responsibilities arising out of her earlier marriage."
Today, on the very outset, counsel for the petitioners seeks withdrawal of the present petition.
Dismissed as withdrawn.
