CWP No.17190 of 2019 and -8SHEEL NAGU, CJ. (ORAL) 1.

This order shall dispose of the above numbered 31 petitions together as the common question of law and facts are involved therein. 2.

Learned counsel for the rival parties do not dispute that the cause raised herein has become infructuous.

3.

Before parting with the order, it is essential to state the brief facts of the case:

The challenge in these petitions is to the Vires of Rules 8-B and 10 of the Haryana Civil Services (Executive Branch) Rules, 2008 alongwith other prayers.

4.

By an interim order passed by this Court on 11.7.2019, the petitioners were provisionally allowed to participate in the written exam which was an objective type test.

5.

Pursuant to the aforesaid interim order, all the petitioners appeared in the written examination on the date scheduled for the examination but the results of all the petitioners has been kept in a sealed cover.

6.

Respondent no.2 in its reply has revealed, inter alia, that the petitioners, who were provisionally allowed to appear in the examination, could not come within the zone of consideration for being called for interview for appointment for the post of Haryana Civil Services (Executive Branch).

7.

In view of the above, deciding the question of vires would be an academic exercise which this Court would not like to undertake.

CWP No.17190 of 2019 and -98. Keeping the question of law open, the petitions have become infructuous and are dismissed as such.

9.

Photocopy of this order be placed on the connected case files. (SHEEL NAGU) CHIEF JUSTICE (SUMEET GOEL) JUDGE 15.5.2025 Ashwani Whether speaking/reasoned:
