Present petition has been filed by Sanjay for production of detenues, namely, Mahavir Prasad, Kailash Lal, Banna and Jaipal @ Dhaulia. On his petition, Warrant Officer was appointed, who visited the concerned police station and gave his report wherein he stated that neither of the detenues was found available in the police station when he visited the same. SHO Maya Singh, Police Station Uklana made the statement that aforesaid persons were called to Police Station on 07.03.2017 in connection with investigation of case bearing FIR No. 46 dated 07.03.2017 and after investigation they were allowed to got home as they were found innocent. Kailash son of Sant Lal and Jaipal @ Dhaulia, the alleged detenues, were standing outside the police station and on asking of the petitioner, they got recorded their statement with the Warrant Officer regarding their beating by the police.

CRWP No. 281 of 2017 -2Learned counsel for the petitioner submits that after filing of this petition, petitioner has been involved in case bearing FIR No. 46 dated 07.03.2017. He seeks permission to withdraw the instant petition with liberty to avail all other legal remedies available to petitioner under the law and to challenge his involvement in false case.
