ARUN PALLI, J. (ORAL) The petitioner prays for a direction to the respondents to grant her the minimum basic pay and Dearness Allowance etc., in the regular pay scale, as awarded to other regular employees of the respondent University, on the principle of "equal pay for equal work". In paragraph No. 4 of the preliminary objections raised by the respondents in their written statement, it is revealed that the petitioner had, in fact, resigned from service on 19.11.2012, which was duly accepted by the Vice-Chancellor, and the present petition has since been filed three years thereafter. This position has not been controverted by the petitioner by filing replication or any counter affidavit, despite opportunities. Even today, on being pointedly asked, learned counsel for the petitioner pleads ignorance. That being so, the stand set out in the written statement by the respondents is deemed to have been admitted. CWP-13843-2015 the petitioner is no longer in service, and no relationship of employer and employee exists between the parties, the relief being claimed in the petition, is wholly misconceived.
The petition is accordingly dismissed.
