(ORAL) On previous date of hearing, this Court had passed following order:- "The grievance of the petitioners, who are working in District Courts, Haryana, in the present writ petition, is that respondent No.2, vide impugned notification dated 30.05.2019 (Annexure P-3) and Advertisement dated 13.06.2019 (Annexure P-4), has directly excluded/debarred the employees of Haryana Vidhan Sabha, High Court of Punjab and Haryana and District Courts as well as Haryana Public Service Commission, for appointment on the post of HCS PANKAJ KUMAR 2019.07.05 19:25 I attest to the accuracy and integrity of this document

Kanwal Goyal, Advocate, representing respondent Nos.1 & 2, respectively, who are present in Court, seek time to apprise this Court regarding debarring/disentitling the employees of aforesaid Institutions/Departments, for appointment on the aforesaid post.

Ms. Palika Monga, DAG, Haryana informed this Court that vide notification dated 4.1.2019, Haryana Civil Service (Executive Branch) Rules, 2008 have been amended whereby applications from amongst eligible members of Group-C Service shall be sent by Heads of Departments, Haryana through their Administrative Secretaries in the prescribed form whereas employees of Haryana Vidhan Sabha, High Court of Punjab and Haryana, District Courts as well as Haryana Public Service Commission shall not be covered therein.

Learned counsel appearing for petitioners relied upon Annexure-1, sub-Rule 8 of Rule 38 of Haryana Civil Service Rules (General), 2016, Registrar of Punjab and Haryana High Court has been recognized as Head of Department of Haryana but since there is no challenge to Rules, seeks withdrawal of the writ petition with liberty to challenge the aforementioned Rules in accordance with law. Ordered accordingly.
