(Oral) Learned counsel for respondent No.1 - Bank submitted that the primary grievance of the petitioner is regarding the auction of the residential house, which was fixed by the respondent Bank. It was submitted that since the date of said auction had expired and the property could not be auctioned, the present writ petition has been rendered infructuous. 2.

Learned counsel for the petitioner states that there are certain ancillary issues which have arisen in the writ petition, therefore, he may be allowed to withdraw the present writ petition with liberty to the petitioner to approach the D.R.T. or any other appropriate Forum, in accordance with law.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to him, in accordance with law.
