(Oral) Present petition has been filed with a prayer that proper investigation in the FIR No. 416 dated 28.08.2020, under Sections 328 and 376-D IPC, registered at Police Station Quilla, District Panipat be done by the respondents by constituting a Special Investigation Team. Learned counsel for the petitioner argues that though approximately one month has passed since the lodging of the FIR, no action has been taken by the police in this regard to arrest the accused. Learned counsel for the petitioner submits that the grievance, which is being raised in the present petition, has already been raised before respondent No. 3 i.e.

The Superintendent of Police, Panipat by filing a complaint (Annexure P-2) on 15.09.2020 and the said complaint is still pending consideration with respondent No. 3 and the petitioner will be satisfied in case a direction is issued to respondent No. 3 to decide the complaint in a time bound manner NARESH KUMAR 2020.09.

Notice of motion.

Ms. Safia Gupta, learned Assistant Advocate General, Haryana, who has also joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State. Learned State counsel raises no objection with regard to the prayer of the petitioner for deciding the complaint dated 15.09.2020 (Annexure P-2) by respondent No. 3 in a time bound manner. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No. 3 i.e. The Superintendent of Police, Panipat is directed to decide the complaint dated 03.09.2020 (Annexure P-2) within a period of eight weeks from the receipt of copy of this order.
