Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.97 dated 08.06.2015 under Sections 323, 393, 34 IPC and Section 25 of the Arms Act (Section 304 IPC added later on), registered at Police Station Uchana, District Jind. Notice of motion.

Mr.Navdeep Singh, Asstt. Advocate General, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per prosecution version, three boys came to Petrol Pump and took salesman namely Vijay inside the office of the complainant-Phool Singh. When one boy gave butt blow on the head of Vijay, a fire was shot, VINEET GULATI 2019.09.11 16:31 I attest to the accuracy and authenticity of this document Chandigarh which hit one of the person from the accused side, who fell down and later

Vijay and Phool Singh have already been examined before the trial Court and they have not supported the prosecution version and turned hostile.

The petitioner has been in custody since 21.08.2015. He is not required for any investigation or interrogation purposes as he is in judicial custody. The trial of the case will take time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, in view of the custody period and without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with two sureties in the like amount each to the satisfaction of the trial Court/Duty Magistrate.
