Jaswant Singh,J(Oral) Petitioner-Sohan Lal, an ETT Teacher has challenged the order dated 25.06.2016(P-3) whereby he has been transferred from Government Primary School,Papial to Government Primary School, Jaidpur. It is claimed that the petitioner and his wife both are ETT Teachers and the transfer has been effected without keeping in view the stated preferences and being a couple case. It is further submitted that the transfer order of Radha Rani, in whose place of posting the petitioner has to join, has already been stayed in CWP No.12869/2016. This Court while issuing notice of motion on 8.7.2016 had stayed the transfer orders qua petitioner.

At the time of hearing, Mr.Manuja, Additional Advocate General,Punjab states that none from the office of District Education Officer, Pathankot has come present and, therefore, he is unable to assist the Court.

CWP 12982/2016 Learned counsel for the petitioner has produced a copy of the order dated 12.7.2016 passed by District Education Officer(EE)Pathankot whereby the impugned transfer of the petitioner vide P-3 stands cancelled and he was directed to report back to his old station. Copy of said order is taken on record.

In view of the above, present writ petition has become infructuous and disposed of accordingly. It is clarified that the admissible benefits will be released to the petitioner as if transfer order P-3 was never passed.
