(Oral) The petitioners' land alongwith a big chunk of land situated within the revenue estate of village Uchana Kalan, Tehsil Narwana, District Jind was acquired for the construction of a Grain Market by the Haryana State Agriculture Marketing Board. Out of that land, 1.38 acre land which was incidentally owned by the petitioners, has now been given to the Department of Public Works (B&R) for construction of a Government Rest House. The petitioners allege that the above-stated diversion amounts to change of public purpose for which the land was acquired, hence the acquisition is bad.

Having heard learned counsel for the petitioner at a considerable length and after going through the record, we do no find any merit in the petitioners' contentions. Once the acquired land vests in the State Agencies free from all encumbrances, State can use such land for a changed public purpose also, i.e., other than for which the land was originally acquired. The change of public purpose for the purpose of utilization of acquired land would not vitiate the acquisition process.

Dismissed.
