Learned State counsel has pointed out that petitioners are seeking remedy in two Courts simultaneously, inasmuch as they have filed a suit for declaration in Civil Court at Amritsar as well as the present writ petition and the subject matter of both is same. Learned counsel for the petitioners states that he undertakes to withdraw the civil suit pending before Civil Judge (Sr. Divn.), Amritsar within a week and the present writ petition be disposed of by directing the respondents to consider the legal notice dated 17.8.2020 (Annexure P7) served by the petitioners upon the respondents and take necessary action within a fixed time frame. Accordingly, the present writ petition is disposed of directing the official respondents to consider the claim of the petitioners as contained in legal notice dated 17.8.2020 (Annexure P7) and then to take necessary action in the matter, if so warranted, in accordance with law within a period of two months from the date of receipt of certified copy of this order. It is made clear that since the writ petition has not been decided on merits, if after passing of order by the official respondents with regard to the legal notice, the petitioners still feel aggrieved, then they may take recourse to the legal remedy, in accordance with law.
