The present petition has been filed by the petitioners for issuance of an appropriate directions to respondents No.2 and 3 to protect their life and liberty from respondents No.4 and 5. It is submitted by learned counsel for the petitioners that petitioners are major and copies of their Aadhaar Cards have been annexed, to substantiate this version. Furthermore, it is submitted that respondents No.4-Gurmeet Kaur, is the mother and respondent No.5-Iqbal Singh, is the maternal uncle of petitioner No.1-Khushlovepreet Kaur. They are pressurizing petitioner No.1 to lodge FIR against petitioner No.2-Jatin Kumar, otherwise, he will be eliminated. Also, it is submitted that petitioner No.1 was confined by respondents No.4 and 5, but somehow, she managed

CRWP-5304-2024 -2to escape from the clutches of the private respondents and thereupon, had executed an affidavit dated 29.05.2024, thereby, stating herself to be in love with petitioner No.2 and that her mother is interested to solemnize her marriage with some other person.

It is further submitted by learned counsel for the petitioners that now the petitioners are receiving threats, at the behest of respondents No.4 and 5. Also, it is submitted that a representation was made to Superintendent of Police, District Yamuna Nagar, copy whereof is Annexure P-4, which was made on 30.05.2024 and the same is still pending. Notice of motion.

Mr.Dimple Jain, Deputy Advocate General, Haryana, who is present in the Court, accepts notice on behalf of respondents No.1 to 3. Learned State counsel submits that FIR has already been got registered at the instance of petitioner No.1-Khushlovepreet Kaur against petitioner No.2-Jatin Kumar under Section 6 of the POCSO Act, 328 and 506 IPC. On query by the Court, it is disclosed by learned State counsel that at the time of registration of the FIR, petitioner No.1 was in the custody of her mother-Gurmeet Kaur. However, now petitioner No.1 is in the custody of petitioner No.2-Jatin Kumar.

In response thereto, learned counsel for the petitioners submits that the petitioners have already filed a representation, copy whereof is Annexure P-4 and the same is pending.

In the given circumstances, on the assurance given by learned State counsel, it is ordered that concerned Superintendent of Police, District

CRWP-5304-2024 -3Yamuna Nagar, shall decide the representation (Annexure P-4), within period of seven days and proceed in accordance with law, if any action is called for.

In view of the aforesaid terms, the present petition stands disposed of.
