(Oral) Prayer in this 2nd petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.183 dated 01.12.2022 registered under Section 21 of the NDPS Act (Sections 25 and 29 of the NDPS Act added later on) at Police Station Zira, District Ferozepur.

On the last date of hearing, the following order was passed:- "Learned State counsel submits that the petitioner was declared proclaimed offender in the present case, however, in the petition it has been stated that the petitioner has never been declared as proclaimed offender and he seeks time to file short reply, in this regard. Adjourned to 12.08.2024."

CRM-M No.32304 of 2024 (O&M) Learned State counsel has filed short reply by way of affidavit of Gurdeep Singh, Deputy Superintendent of Police, SubDivision Zira, District Ferozepur, in the Court, which is taken on record and along with the said reply, the order dated 03.06.2023 has been attached whereby the petitioner was declared as proclaimed person. Learned counsel for the petitioner wishes to withdraw the present petition.
