Petitioner (Jagsir Singh) has filed this second petition under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the petitioner in case FIR No.89, dated 05.06.2021, under Sections 302 and 323 read with Section 34 of the Indian Penal Code, 1860, registered at Police Station Sardulgarh, District Mansa.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition. CRM-M-31478-2024 -2the trial, complainant already stands examined and only the official witnesses are left to be examined; therefore, appropriate directions be issued to the trial Court to conclude the trial in a time bound manner. 3.

Learned State counsel as well as learned counsel for the complainant do not oppose the aforesaid course of action. 4.

Considering that the petitioner is in custody since 14.06.2021 and the complainant already stands examined and only official witnesses remain to be examined, the trial Court is directed to conclude the trial within a period of nine months from the next date fixed before the trial Court. 5.

In view of the above, the petition is disposed of accordingly. 6.
