**** ALOK JAIN, J. (Oral) Learned counsel for the petitioner does not deny the fact that the custody of his wife is with her parents and hence, prays for withdrawal of the present petition.

Learned State counsel has filed the status report and it is has been submitted that since the victim was found to be minor as her date of birth is 01.10.2005, the petitioner has been charged with Section 376 of the Indian Penal Code and Section 04 of POCSO Act. Respondent/State shall proceed in accordance with law and filing of this petition shall not be considered as any alibi or defence to the petitioner in the said trial.

Accordingly, the present petition stands dismissed as withdrawn.
