G.S.SANDHAWALIA, J. (Oral) The petitioner seeks consideration in the light of Annexures P1, P-2, P-8 and P-9 to grant him permission to appear in the second semester of JBT examination which was to start from 16.07.2016. It is the case of the petitioner that he had failed to appear in three subjects of the second semester in July, 2014 due to his ill health and poor medical condition. He had filed an application for mercy chance, which had been rejected on 31.03.2016 (Annexure P-10). However, his legal notice sent had also been forwarded to the higher officials. It is his case that he had passed other subjects for the other semesters and also the HTET held on 18.12.2015 (Annexure P-6).

In reply filed by respondent no. 1-Board, it has been admitted that the matter was reconsidered on the receipt of the representation and the Chairman had agreed to grant extra chance to appear in the examination Shivani Gupta 2016.12.02 11:34 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 13200 of 2016 held in July, 2016. However, on account of the shortage of time, the petitioner could not be contacted on his telephone, both on the landline and the mobile.

Keeping in view the above fact that in principle the decision has been taken, the respondent-Board shall act upon the decision of the Chairman and grant the petitioner additional chance with adequate notice to the petitioner as to when the examinations are to take place. With the above said directions, the present writ petition stands disposed of.
